The European Commission has launched two investigations under the Foreign Subsidies Regulation to examine potential market distortions in EU public procurement. These investigations were triggered by notifications from the ENEVO Group and Shanghai Electric regarding a Romanian photovoltaic park project, partly funded by the EU Modernisation Fund. The focus is on determining whether these companies, having received over €4 million in foreign financial contributions from third countries in the past three years, gained unfair advantages in securing contracts exceeding €250 million. The goal of these inquiries is to uphold fair competition and ensure compliance with regulations governing foreign subsidies in EU procurement.
