Patent battle escalates as Shoals Technologies appeals ITC ruling

Shoals Technologies Group, headquartered in Tennessee, has appealed to the US Court of Appeals for the Federal Circuit, challenging the International Trade Commission (ITC) decision that overturned an Administrative Law Judge’s ruling on its ’153 Patent. The appeal seeks a de novo review, meaning the court will independently interpret the patent without considering the ITC’s previous decision. Shoals contends that the ITC’s reversal should be overturned, reinstating the initial determination that Voltage’s LYNX trunk bus products infringed its patent. If successful, the ruling could confirm infringement or send the case back to the ITC for further review. Separately, the ITC has opened a new investigation into Voltage’s alleged infringement of Shoals’ newly issued ’375 and ’376 patents, which cover an improved trunk bus lead assembly.
