HERC approached over Siwana Solar’s PPA tariff dispute

Siwana Solar Power Projects Ltd., an India-based company, has approached the Haryana Electricity Regulatory Commission (HERC) over tariff disputes in its 25-year PPA with the Haryana Power Purchase Centre (HPPC). Signed in February 2014, the PPA set a tariff of INR 6.44/kWh (~$0.08/kWh) for its solar plant commissioned in December 2014. Siwana Solar later sought a higher generic tariff of INR 7.45/kWh (~$0.09/kWh), applicable for FY 2014-15 projects. HERC upheld the original INR 6.44/kWh tariff, but HPPC applied a reduced rate of INR 5.68/kWh (~$0.07/kWh), citing unrelated agreements. Siwana Solar claims this violates its contract. Following litigation in APTEL and the Supreme Court, the company seeks enforcement of HERC’s order to maintain the agreed tariff.
